DISABILITY LEAVE FOR GYN.
Dear Patients:

It has come to the attention of this practice that some patients are having serious problems with employers as it relates to disability leave. It is imperative that all patients realize the seriousness of this matter. With the advent of managed care, employers are aware and concerned about time off from work. What is beginning to happen is that patients are losing jobs due to being out of work beyond the customary allotted times.

Employers are requesting documentation (medical records) explaining medical conditions that require leave for time off above and beyond the normal recovery period. This office will not falsify medical data pertaining to patients being out of work beyond the allotted time. Please remember a doctor's excuse is only treated as a recommendation. It does not guarantee leave with pay or disability. We would not want you to lose your job or receive financial reprimand for a stay out of work beyond the customary or stipulated time. Remember that your employer has the last say in these matters.

Please note the usual and customary leave for surgery:
1) Minor Surgery (outpatient care) - one week
2) Major Surgery (inpatient care) - six to eight weeks


Please be advised that the usual and customary leave may or may not be granted by your employer. Physicians cannot overrule your employer, they may only recommend what they feel is medically indicated.

Note that the Federal Family and Medical Leave Acts allows leave for certain qualifying conditions but does not mean that one gets disability pay nor paid leave. Your company policy dictates what payments are allowed. The FMLA gives a maximum allowable time but not all conditions qualify for the maximum twelve (12) weeks.

It is our hope that this letter will clear up any confusion or misunderstanding as it pertains to leaves and disability. This office must adhere to these guidelines because our letters and statements become legal documents. It is your responsibility to know what your employer and or your insurance company will or will not allow with respect to disability. Please make sure you take the initiative on being knowledgeable of these issues.
